Koh Samui Property for Sale
There are a wide range of styles and types of Property for Sale in Koh Samui. They can be essentially be divided into the following categories:
Villas for Sale – this is the most common choice for foreigners buying property in Koh Samui. Villas are typically bigger than ‘houses’ and have more luxury amenities such as swimming pools etc. The most popular option for the mass-market is a 2 or 3 bedroom villa, normally sea-view or for local expat investors often garden-view villas are a frequent option, such as some of the recent new Bali Villas for Sale.
Luxury Villas for Sale – these are increasingly the favourite of more affluent overseas investors and locals. Luxury Properties would generally feature sea-views, large swimming pools, landscaped gardens and a high-quality of construction and finishing. The latest trends for Luxury Villas in Koh Samui offer stylish modern architectural features, such as curved roofs, dramatic cantilevers, some with industrial stylings.
Duplex Villas – duplexes are defined by a shared common-wall and are often located in prime popular areas where the land prices are higher, and the need to save on space becomes more paramount for developers. In the Samrong bay next to the famous Six Senses resort there is a new development of Luxury Duplex Villas that has been built and expanding gradually over the last few years.

Condominiums for Sale – condos are a popular choice for foreigners owning property in Thailand, due to the legal system that allows 49% of the total available units within condominium projects to be sold freehold for foreigners in their personal name – meaning their full name can be registered on the property title deed. (Chanote) The other difference between condos and apartments is the rights of ownerships; whereby with condos the owners have a share of the common facilities and collective freehold of the building. This in turn has the associated monthly or yearly management fees for communal swimming pools, fitness centers, receptions etc.
Apartments for Sale – apartments are different by legal structure. For Thai apartments often there is no share of the common areas, and they are often more cheap and affordable accommodation options, especially in the major cities in Thailand. However normally for foreigner buyers there are luxury apartment options, also with shared luxury amenities, whereby the ownership is a secure leasehold option – meaning a collective share of the freehold. Often these ‘secured leasehold’ apartments carry a 30x30x30 year ownership, with the collective freehold of the property being owned pro-rata by the owners. Often this freehold deed and company is help off-shore, making it easier for owners to control the ownership and renewal of their lease.
Commercial Property – this primarily concerns businesses, from hotels & resorts, to independent shops, commercial townhouses and premises. The zoning regulations for commercial property for sale compared to residential property are fundamentally different. There are also ‘mixed-used’ commercial developments and buildings; where the lower section of the property is used as a business and the upper level(s) is used as a residential dwelling or series of apartments.
Land for Sale – there are many different types of land for sale in Koh Samui, from beachfront land for sale to sea-view land for sale, and flat land. The land for sale on Koh Samui is governed by strict zoning laws and associated Building Regulations, which dictate the style, type, height, size and ratio of building available. These regulations also depend on the height above sea-level of the land, the level of the slope, and proximity to other buildings. How to Buy Property in Koh Samui
Buying property in Koh Samui can be a highly enjoyable and financially rewarding experience, however without the correct knowledge, support and guidance, your dream can rapidly turn into a nightmare – especially when building your own property!
Before embarking on your planned property purchase in Koh Samui, it is important to do your own research. There are a lot of quantity of agencies and lawyers on the island, but the quality of reliable, reputable and qualified ones is scarcer. While you are researching which agency you would like to select for your services, it is helpful if you already have a general understanding of the basic geography of the island and your preferred areas and approximate requirements and budget range, as this can make the property selection by the agent more successful.
When selecting a Real Estate Agency in Koh Samui it is important to do your own homework and not be swayed too much by Google – after all Google is not a friend or referral, and can easily be tricked into ‘recommending’ unreputable agencies. When selecting your preferred property agency, ideally try to make sure the company has excellent Google reviews, as this transparency of information can quickly tell you what customers really think – just be careful to check if they seem real reviews or fake. (You can normally tell by the tone/length and the type of person leaving the review.)
Another important point to check is whether the Property Agency in Koh Samui has an official registration number and a Company Office. The reason this is so important in terms of credibility and security, is it means the company is accountable and traceable. With more amateur firms or individual ‘freelancers’ they can easily run-away if there is a problem, leaving you stranded sometimes in a difficult legal situation. Additionally, it is always nice of course to have somewhere cool where you can meet the agent sheltered away from the heat, to review plans, contracts or brochures etc.
After you have chosen your favorite Koh Samui Real Estate Agent, try to disclose as much information as you possibly can to the agent about what type, style, size and priced Property for Sale in Koh Samui you are looking for. You should be working with them in partnership to ‘hone-down’ hundreds of options sometimes to a shortlist of 5-10 favorites, to make it easy for yourself to select the best property to buy.
As you are in the process of refining your preferred property options it is advisable to begin shortlisting a reputable Local Lawyer. If you don’t already have your own local lawyer in Koh Samui and you have a trusting relationship with your agent, it is advised to trust their recommendations, as choosing the wrong lawyer can also be an expensive and costly mistake. In Koh Samui it is not always the case compared to Bangkok of ‘biggest is best’ (most reliable) – you want to be selecting a legal firm with a qualified local Thai lawyer who can represent you and communicate with you clearly and calmly. (Note: foreigners in fact cannot work as lawyers in Thailand, but only as Legal Advisors.)
As you begin to shortlist your favourite Koh Samui Properties, make sure you have crossed-off all the crucial questions as a check-list before you make a financial commitment.
‘Is the property freehold or leasehold?’
‘Is the property big enough to support your needs?’
‘Does the property seem structurally sound?
‘What is the surrounding area like at all times of day?’
‘Are there any fixed management fees or hidden costs?
‘Is there a CAP on the management fees appreciation in cost per year?’
These are just some of the important questions that need to be discussed with your agent or physically checked in person, before paying a deposit on a property.
After selecting your final preferred property to purchase, it is recommended to sign an initial ‘Reservation Agreement’ so that both the buyer and seller can see each other is serious, and the property is blocked (taken off the market) whilst your selected lawyer conducts the necessary legal checks and searches (‘due diligence’) – normally this would be for period of around 30 days.
The Reservation Agreement also covers your deposit, ensuring that you will receive a refund in full if the property does not pass ‘due diligence’. However, it is normally not a ‘right of cancellation’; meaning you cannot simply cancel the agreement for personal reasons not connected to the legalities of property, or you will in all likelihood forfeit the deposit.
Once the property has been ‘reserved’, this gives your lawyer the time needed to complete the legal checks of title deed, access, registration, taxes, company (if applicable) and so on.
It also gives you the time to agree to a final draft of a Sales & Purchase Agreement, which sometimes can take a few revisions, before both the buyer and seller are satisfied. If you are purchasing and ‘off-plan’ property it is advisable to have the final property plans ‘annexed’ onto the back of your contract.
It is also important to define the payment plan of an off-plan property, in relation to the construction stages – this is very important for your security, and holding the developer accountable. It also means essentially ‘you only pay for what you receive.’
Another point to cover in your contract with your lawyer and the seller, is indeed what is included and what is not. Is the property ‘sold as seen’? Are there any personal items not included? Such points are paramount to your own security as a buyer in a smooth property transaction.
Once the Sales & Purchase Agreements have been drafted, agreed and signed, the property is ready for transfer of ownership. Of course, the nature of this depends on whether the buyer is Thai or foreigner, and whether the property and/or land is owned by a Thai company or Thai individual.
For example: is the land held in a company, and the property/building is owned in a personal name? These points can hugely affect the associated taxes involved with your purchase, so it is paramount they are discussed early on in the property transaction and also ideally defined clearly in your contract.

Once all taxes have been paid and the property purchase funds have been paid and normally registered at the land office, the property can be legally transferred to you or your company name. A housing book of registration (Tabien Bahn) will also be provided by your lawyer from the municipality (Tessabaan) – this will normally be blue colour for Thai nationals and Thai companies, and a yellow colour for foreign owned properties – for example condominiums.
Once all these processes are complete and your agent & lawyer have checked the electricity meter registration is in your name and any other last final checks, you can breath a sigh of relief or celebrate as the proud owner of your own Property in Koh Samui.
