People from all over the world are buying properties in Koh Phangan, Thailand for personal use or business purposes. There are a number of good reasons why properties in Thailand’s fifth largest island (which is sometimes spelled as Koh Pha-ngan) are currently selling like hotcakes.
While the island is arguably most popular for its monthly Full Moon Party, which is held at Haad Rin Beach and welcomes about 30,000 attendees (majority are tourists), thousands of people regularly visit it to enjoy its white-sand beaches. In addition, it also has many fun attractions such as diving (you can choose from more than 20 sites), kayaking, snorkeling, and more.
Koh Phangan has a perimeter of only roughly 40 kilometers, which means you can walk around the entire island in just 10 hours. More than half of it are national parks, and there are more than 80 square kilometers of rainforest in the island as well.
However, many people from all parts of the globe choose not just to visit Koh Phangan for the beaches, parks, and parties. Many of them decide to buy a property in Koh Phangan because of the island’s relaxing ambiance and the high rental return percentages on property investments.
In addition, the cost of living in this island (and throughout the rest of Thailand) is far lower compared to most other places in the world. Because of these, Koh Phangan has become one of the most preferred tropical island destinations of mid- and upper-market holiday tourists, as well as an increasing number of permanent residents from various countries.
Thai property law is often confusing for foreign nationals, and is quite unregulated. If you decide to buy a house in Thailand, you need to work with a property lawyer who can guide you through the entire legal process.
Based on the Land Code of Thailand, foreign ownership and improvement of land is not allowed. However, there are exceptions to this law. As a foreign national, you can purchase a house or villa in Koh Phangan in two ways:
The more common way for foreign nationals to buy properties in Koh Phangan is through leasehold. They use lease contract deals over a period of 30 years. At that time, they are equally covered as owners of the freehold. This contract may be renewed or extended up to two times. The land may be possessed by the foreign national for up to 90 years.
In spite of this, however, the foreigner cannot assume ownership of the property once the contract period ends since the material asset will be taken out from the estate.
An alternative means for a foreign national to buy a property in Koh Phangan, Thailand, is by forming a limited liability company in Thailand.
This method — which is also referred to as a freehold — is more suitable for people with greater financial capabilities. In this strategy, the foreign national’s company will have the freehold land registered under the company name. With one of the company investors/owners eligible for up to 49 percent, two or more foreign national shareholders are allowed. The company’s managing director (i.e., the foreign national) will have power over voting and other shares, as well as full control of the property.
